The place of arbitration shall be Hollywood, Florida. The arbitration shall be conducted in the English language before a single neutral arbitrator. The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction.
YOU AND BATTERY OPERATED TOYS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
